The Site provides the following services: We sale underfloor heating products and accessories. You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions.


If you do not agree with all of these Terms and Conditions, then you are prohibited from using the Site and Services and you must discontinue use immediately. We recommend that you print a copy of these Terms and Conditions for future reference.


1.2  The supplemental policies below, as well as any supplemental terms and condition or documents that may be posted on the Site from time to time, are expressly incorporated by reference.


1.3  We may make changes to these Terms and Conditions at any time. The updated version of these Terms and Conditions will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. 5. Make a contract with us

5.1 When you place an order with us, you are making an offer to buy goods. We will send you an confirmation email that we have received your order.

5.2 In the unlikely situations that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will receive an e-mail with update of your order.

5.3 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and will not include any of the pictured accessories, unless stated in the specification of the goods. Whilst goods may be shown assembled they may require assembly by you.

5.4 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.

5.5 This contract is covered by English law.

5.6 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

 

6. How to place order     

6.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.

6.2 The buyer assumes responsibility for the goods being suitable for the purpose for which they are being purchased.

6.3 Carriage charges will be shown prior to you placing your order.

6.4 You will be required to pay for the goods in full at the time of ordering.

6.5 We use secure payment facilities for online purchases. You can pay for your order by Visa, Mastercard or PayPal.

6.6 All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate.

6.7 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.

7. Delivery & Carriage Charges

7.1 Goods will be dispatched from our warehouse within 14 working days and any estimated dispatch date is an estimate, which can change without notice. Dispatch may be delayed in accordance with point 7.10.

7.2 We will deliver goods within 2-3 working days of dispatch. Deliveries may be delayed in accordance with point 7.10.

7.3 Your order may arrive in more than one delivery.

7.4 We will deliver the goods to the premises you specify on your order. You must be at home to accept delivery of your order, which is between 7:30am and 6:00pm Monday-Friday.

7.5 If there is no one to accept the order on the scheduled delivery date the goods may be returned to the factory and we reserve the right to charge you an additional re-delivery charge.

7.6 If you change the delivery address once the goods have been dispatched to you, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery, if the carriers are able to make the change. This will delay your delivery.

7.7 Please check the goods on delivery - any goods found to be missing or damaged should be notified to the delivery driver at the time of delivery or ourselves within two working days of delivery of the items.

7.8 If the goods are lost or damaged please report this to us within two working days from the delivery day.

7.9 Deliveries are made to a ground floor entrance only and on the condition that there is reasonable access for the safe and prompt delivery of the goods.

7.10 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, malicious damage or the default of our suppliers. We are not responsible where this causes a delay or failure in delivering your goods.

 

8. Cancellation and returns

8.1 You can cancel your contract at any time up to 7 days after the day of delivery. To do this, please e-mail us. We are unable to accept cancellations by phone.

8.2 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.

8.3 If you cancel, you must return the goods within 7 days of cancellation, complete with the original packaging to us and/or our supplier (or any other UK address specified by us), at your own expense. You must ensure that the goods are packaged adequately to protect against damage.

8.4 If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

8.5 We will refund amount paid to us by you including any postage / carriage within 30 days, less any costs due under this contract.

8.6 We reserve the right not to replace any item that has been fitted, as we will deem this acceptance of the goods.

8.7 We will not be held liable for fitters fees or any other professional trades persons fees due to late, damaged or lost deliveries.

8.8 We are not liable for any loss earnings due to late, incorrect or lost deliveries.

8.9 We reserve the right to refuse replacements on any damaged items reported to us outside of two working days.
This cancellation policy does not affect your legal rights - for example, if goods are faulty or misdescribed

    

 

9.    Disclaimer/Limitation of Liability     

9.1 Whilst we do take all reasonable steps to make sure that the information on this website is accurate at all times, we do not guarantee that all material is accurate

9.2 All material contained on this website is provided without any or warranty of any kind. You use the material on this website at your own discretion.

9.3 We do not accept liability for any loss or damage that you suffer as a result of using this website.

9.4 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.

   

10.    Term and Termination     

10.1  These Terms and Conditions shall remain in full force and effect while you use the Site or Services or are otherwise a user of the Site, as applicable. 10.2  Without limiting any other provision of these Terms and Conditions, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site and the Services (including blocking certain IP addresses), to any person for any reason including without limitation for breach of any representation, warranty or covenant contained in these Terms and Conditions or of any applicable law or regulation.  


If we determine, in our sole discretion, that your use of the Site/Services is in breach of these Terms and Conditions or of any applicable law or regulation, we may terminate your use or participation in the Site and the Services or delete your profile and any content or information that you posted at any time, without warning, in our sole discretion.  


10.3  If we terminate or suspend your account for any reason set out in this Section 9, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing.

11.3  Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision.   


11.4  We may assign any or all of our rights and obligations to others at any time.   


11.5  We shall not be responsible or liable for any loss, damage, delay or failure to act caused by any cause beyond our reasonable control.   


11.6  If any provision or part of a provision of these Terms and Conditions is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions.  



11.7  There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms and Conditions or use of the Site or Services. 


11.8  For consumers only  - Please note that these Terms and Conditions, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction expect that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. If you have any complaint or wish to raise a dispute under these Terms and Conditions.


11.9  For business users only - If you are a business user, these Terms and Conditions, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English Law. We both agree to the exclusive jurisdiction of the courts of England and Wales.    


11.10  A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.
